Pegasus Imaging's Corporate Policies


1.) 

Pegasus reserves the right to change pricing without notice.

2.) 

Pegasus price quotes expire 45 days after they are offered.

3.) 

Pegasus products are provided "As Is". You are responsible for determining the fit of these products into your particular imaging application or deployment. Download and try the free trial version of any Pegasus Imaging product to determine if it meets your needs before making your purchase. We do not offer refunds.

4.) 

Pegasus supports current and one previous version of its products and toolkits. Pegasus reserves the right, however, to stop supporting products three years after their last compile or two years after a new version is released. Pegasus does not actively support products that are two or more versions older than the current version. Use of older Pegasus products continue to be governed by the product's licensing terms and copyrights, as Pegasus does not waive any rights over time.

5.) 

Customers with overdue accounts will not be given support by Pegasus Imaging. Pegasus reserves the right to discontinue customers with a 'past due' invoice balance.

6.) 

Pegasus invoice amounts are net of taxes and fees. Pegasus is not responsible for taxes imposed outside the USA. If there are fees or taxes that will be imposed or need to be withheld, let us know IN ADVANCE OF PURCHASE, and we will incorporate this into the billing process. Pegasus will automatically add state sales taxes when appropriate, so if you are a reseller or otherwise exempt please provide us with the appropriate certificates.

7.) 

Your use of any of Pegasus Imaging software or runtimes created with Pegasus Imaging software is allowed under license terms granted by Pegasus Imaging. It is the Licensee's responsibility to honor the terms of such license grants. See License Page: (http://www.pegasusimaging.com/licensing.htm).

8.) 

“Client” and “Server” are general industry terms that might be interpreted in different ways. Pegasus defines “Client” as “a computer operated by a single person.” (This is not to be confused with the definition of “Client” meaning “customer,” as in, "They are our client.") Pegasus defines “Server” machines as “operated by a process” (such as a computer monitoring a folder for files to be processed using Pegasus Code). Literal translations may not be used to circumvent the true Pegasus Licensing intent. If a definition is questionable or confusing contact sales for help. Please note: Placing an installation file on your server that is to be downloaded and installed on client machines, such as a CAB file to plug into Internet Explorer, is one or more Client installations, and not a Server installation, for licensing purposes. The server in this case is just acting as a carrier, much like a CD-ROM or FTP site, and is not the location where the Pegasus Code executes. A computer installation designed to service more than one person, and not a single person, such as a kiosk, is considered a server installation by Pegasus. Terminal services servers are also a type of server where code executes centrally and not on the client CPU.

9.) 

'CPU', 'CORE', 'Seat', 'User', 'Computer', 'Installation' and 'Runtime' are general industry terms that are used interchangeably; however, if a definition is questionable or confusing contact sales for help. 'Multi-processor' computers and 'multi-core' processors (chips) are counted by Pegasus as a single CPU or seat for client installations, so a 'dual-core' processor counts as one CPU or installation. Pegasus reserves the right to count 'multi-processor' computers and 'multi-core' processors as multiple CPUs (licensed runtimes) in certain server environments. (This depends solely on how the server application calls the Pegasus libraries.) Use of Pegasus code in a server environment with mutiple CPUs or COREs should be discussed with sales.

10.) 

Upgrading deployed application with a newer version of a Pegasus product will involve additional licensing. The normal runtime upgrade fee is 45% of current price for a one version upgrade, 65% of current price for a two version upgrade, and 85% of current price for more than a two version upgrade. Customers may avoid these upgrade charges by purchasing both product and deployment support plans. See Support Options: (http://www.pegasusimaging.com/supportagree.htm).

11.) 

The purchase and licensing of any Pegasus product covers only the version at the time of purchase or licensing, unless written and agreed upon stipulations grant past or future versions of Pegasus products explicitly. The absence or omission of a Pegasus product version number in a purchase or license agreement by default grants rights only to the then current version of Pegasus product in discussion at the date of the transaction or agreement, and does not, by such omission, grant any rights to future versions of Pegasus products.

12.) 

Pegasus grants, through a lawfully exercised license agreement with each licensing entity, a limited, nonexclusive, nontransferable license, unless otherwise described with explicit language contained in the license document. In addition, once a lawfully exercised license agreement is completed with Pegasus, the licensee shall not assign, transfer or pledge the Agreement, in any manner, without the prior written consent of Pegasus.

13.) 

You should always test on the hardware you plan to deploy as different hardware vendors supply different device drivers, not always with the same feature set.

14.) 

By downloading any Pegasus Imaging product, you agree that you are not permitted to and will not decompile or reverse-engineer them. You also agree that you will not communicate any quality, speed, memory usage, or other performance measurements to anybody outside of your organization.

All copyrights to Pegasus Imaging development kits and software are retained by Pegasus Imaging Corporation. ALL RIGHTS RESERVED.

16.) 

Pegasus Imaging considers unlicensed use of its software a serious violation of US and international copyright laws. The company will take legal action to protect its rights if warranted. Report unlicensed use.
